AbbVie Loses Challenge to Contract Pharmacy Law in Tennessee

Tennessee’s law prohibiting prescription drug manufacturers from imposing limits on pharmacies participating in the 340B drug discount program doesn’t violate federal law or the US Constitution, a federal judge in Tennessee ruled.

Thursday’s decision to dismiss a lawsuit from Abbvie Inc. and other pharmaceutical companies largely reiterates reasons that US District Court for the Middle District of Tennessee Judge Aleta A. Trauger laid out in denying the drugmakers’ previous request for a preliminary injunction.
