A federal appeals court sided against drugmakers’ bid to block a Louisiana law that regulates how manufacturers can supply federally discounted drugs to pharmacies.
The US Court of Appeals for the Fifth Circuit on Monday affirmed a lower court decision that found Louisiana’s Act 358, which prevents drug companies from denying or restricting the delivery of discounted drugs to pharmacies, wasn’t preempted by the federal 340B statute.
Under the 340B program, drug manufacturers are required to offer discounts on drugs to covered entities, including qualifying hospitals, clinics, and providers, that treat a disproportionate number of low-income and uninsured patients. In ...
