3M Wins Another Chance to Fight State PFAS Case in Federal Court

The Fourth Circuit gave 3M another opportunity to defend itself against Maryland and South Carolina’s chemical pollution lawsuits in federal court, saying the environmental commingling of two types of PFAS showed a federal nexus.

Chemicals manufacturer 3M Co. demonstrated that its decades-long manufacturing of per- and polyfluoroalkyl substances (PFAS) for the government was inextricable from its private manufacturing activities when it comes to alleged water pollution, according to a majority opinion from Judge G.
