A New York doctor failed to show that a federal district court erred in dismissing his False Claims Act suit alleging that online medical appointment company Zocdoc Inc. engaged in an unlawful kickback scheme, the Second Circuit said Monday.
Whistleblower Stephen Sisselman failed to adequately allege that Zocdoc acted willfully as required by the FCA and the Anti-Kickback Statute, the appeals court said in a nonprecedential summary order affirming the suit’s dismissal.
