WSP USA Solutions Inc. can again argue that the US government owes it $14 million under a temporary emergency power contract issued by the US Army Corps of Engineers, the Federal Circuit said Friday.
The Armed Services Board of Contract Appeals improperly concluded that the parties’ $95 million maximum value contract had unambiguous pricing terms before denying WSP USA’s claim, and must on remand conduct a proper investigation of those terms, Judge Todd M. Hughes of the US Court of Appeals for the Federal Circuit said in a nonprecedential opinion.
