Winner Under $670 Million Navy Procurement Blocked From Protest

One of several awardees under a US Navy repairs procurement worth $670 million is precluded from claiming that the Navy’s pricing evaluation terms were ambiguous, the Government Accountability Office said.

Pacific Shipyards International LLC received an indefinite-delivery, indefinite-quantity contract Sept. 11, and on Sept. 18 the company filed a GAO protest alleging that solicitation’s ambiguities caused it to submit a lower price than it would have otherwise.

But an awardee of a multiple-award IDIQ contract isn’t an actual or prospective offeror—a required status to be an interested party to protest under the Competition in Contracting Act, the GAO said. The ...
