Whistleblower Who Lost $34 Million Wants Supreme Court Review

The estate of a whistleblower who lost a $34 million False Claims Act award following a May 6 appeals court ruling wants the U.S. Supreme Court to intervene.

The estate of Robert Cunningham filed an application with the Supreme Court to extend time to file a petition for review from Aug. 29 to September 27.

An extension is proper because the estate only recently retained current counsel, no prejudice will result from an extension, and a petition presenting “significant questions of national importance” is likely to be granted, counsel for the estate said.
