Walgreens Whistleblower Can Advance Medication Counseling Suit

A whistleblower can continue to allege that Walgreen Co. violated the False Claims Act by billing Medicare for “sham” medication counseling known as medication therapy management services, a federal district court said.

Pharmacist Elmer Mosely, “a corporate insider” at Walgreens, adequately alleged that the company instructed pharmacists to perform the services in a manner that fell short of compliance with federal regulations and industry standards, Judge Beth Bloom of the US District Court for the Southern District of Florida said in an order partially denying a motion to dismiss docketed on Wednesday.
