VA Properly Excluded Bidder From California Clinic Procurement

The Department of Veterans Affairs reasonably excluded Progress for Bakersfield Veterans LLC from a competition to lease space for an outpatient services facility in Bakersfield, Calif., the U.S. Court of Federal Claims ruled.

Incumbent contractor and protester Progress for Bakersfield Veterans didn’t show that the VA relied on unstated solicitation criteria before deciding only rival SASD Development Group LLC’s bid should be considered, Judge Eric G. Bruggink said in a decision released Thursday.

Progress for Bakersfield didn’t demonstrate that the department treated bidders unequally before finding SASD submitted the most highly rated bid, the court said.
