A contractor for the US Department of Veterans Affairs failed to show it should get another chance to allege the department improperly terminated its air conditioning service contract for default, the Federal Circuit said Thursday.
Sergent’s Mechanical Systems Inc., which received a warning about delays, didn’t demonstrate that it could satisfy a contract deadline before the termination, Judge Richard G. Taranto of the US Court of Appeals for the Federal Circuit said in a nonprecedential opinion to affirm summary judgment.
