Utah Construction Firm Beats Driver’s Low Wage Retaliation Suit

Wadworth Brothers Construction Co. Inc. stopped a False Claims Act retaliation suit because the whistleblower failed to show that the company knew he was alleging noncompliance with federal wage rules in connection with fraud claims when it terminated him, a Utah federal court said.

Kelly E. Sorenson, a former truck driver for the company, didn’t offer significant evidence that Wadsworth was fraudulently reporting to the federal government that it was paying required wages under the Davis-Bacon Act, Judge Clark Waddoups of the U.S. District Court for the District of Utah said Thursday in a decision granting Wadsworth summary judgment.
