USPS Escapes Lawsuit Over Collision Involving Mail Contractor

The U.S. Postal Service blocked the revival of a lawsuit alleging that the agency was responsible for a mail delivery contractor’s collision with a school bus that injured two children in Puerto Rico, under a First Circuit ruling Friday.

Plaintiffs’ claims that the Postal Service failed to properly inspect Eagle Support Inc.'s vehicles for safety purposes are barred under the discretionary-function exception to the Federal Tort Claims Act, the U.S. Court of Appeals for the First Circuit affirmed.

This exception shields the government from suit for the failure to exercise or perform a discretionary function or duty.
