US Prevails in Challenge to Order Directing Army Corps Contract

The US Court of Federal Claims must reconsider whether Anders Construction Inc. is qualified to win an Army Corps of Engineers contract for diving services in Louisiana, the Federal Circuit ruled Tuesday.

The claims court ruled in 2024 that the Army Corps unreasonably disqualified Anders’ bid for the contract, and permanently enjoined the agency from moving forward with “any entity other than plaintiff.” But the Army Corps properly determined that Anders’ bid was technically unacceptable, Judge Timothy B. Dyk said in a nonprecedential opinion to reverse and vacate the claims court’s judgment.
