US Cellular Stops Whistleblowers’ Suit Over Spectrum Licenses

US Cellular Corp. won dismissal of a False Claims Act suit alleging it lied to the FCC in order to win spectrum licenses in auctions held between 2004 and 2007.

The defendants—which also included Carroll Wireless LP, Barat Wireless Inc., and King Street Wireless LP—were accused of engaging in a scheme to misrepresent the sizes of US Cellular-controlled entities so they could bid on and win licenses the government set aside for small businesses.

The suit—filed in 2015—must be dismissed under the FCA’s public disclosure bar because whistleblowers Mark O’Connor and Sara Leibman based their claims on a suit filed ...
