A whistleblower’s claims that United Biologics LLC violated the False Claims Act by improperly billing Medicare and Medicaid for allergy services are barred under the FCA’s first-to-file rule, a Georgia federal court said.
Terri Nix, a former consultant and business development representative for United Biologics, filed her suit while a suit over the same conduct was pending in Texas federal court, Judge Leigh Martin May of the U.S. District Court for the Northern District of Georgia said Wednesday.
