TriWest Health Contract Win Affirmed After Subcontract Changes

Health Net Federal Services LLC lost its protest of TriWest Healthcare Alliance Corp.'s $65 billion managed healthcare support services contract because it didn’t demonstrate any material misrepresentations in the winning bid.

Health Net said TriWest should have been disqualified because its bid didn’t meet the Defense Health Agency’s 25% goal of small business participation. Much of the subcontracted spending was actually allocated to “other than small” businesses, Health Net said.

Health Net’s calculations may have been accurate as to TriWest’s initial bid, but TriWest’s final bid reasonably earned an “acceptable” rating for the subcontracting plan, Judge Ryan T. Holte of ...
