ThunderCat Too Late to Protest VA’s $410 Million Procurement

ThunderCat Technology LLC lost its protest alleging that the US Department of Veterans Affairs failed to conduct adequate discussions before eliminating the company’s bid for a $410 million endpoint device task order.

The protest must be dismissed as untimely because ThunderCat was required to file it by Sept. 21, 2022—the VA’s bid deadline—but the protest wasn’t filed until Nov. 28, the Government Accountability Office said in a decision released Friday.

ThunderCat argued that the GAO should invoke a “good cause exception” to timeliness rules because of the VA’s “brazen” violation of rules for discussions.
