Thales Fails in Protest of BAE’s Radar Subcontract Procurement

Thales LAS France SAS’ protest of BAE Systems Technology Solutions & Services Inc.'s conduct of a subcontract procurement for radar arrays should be dismissed because the procurement wasn’t issued by the US government, the US Government Accountability Office said in a decision released Monday.

Thales argued that BAE, acting as a representative for the US Space Force, improperly refused to sign an end-user certificate allowing the bidder to transmit a subcontract proposal. But the GAO said it lacked jurisdiction over the protest because the Space Force didn’t control the subcontract procurement.
