Texas Surgery Practice Fails in Bid for New Medicare Fraud Trial

Peripheral Vascular Associates PA isn’t entitled to a new False Claims Act trial for Medicare fraud, but the damages award against it will be cut by $3.7 million, a San Antonio federal court said.

A jury in 2022 found that Peripheral should pay $8.1 million for billing Medicare for services it didn’t perform. The court said in a January 2023 order that this award must be recalculated using a different methodology.

Judge Xavier Rodriguez of the US District Court for the Western District of Texas on Jan. 30 entered the new award of $4.4 million based on an interest-based model ...
