Teva Loses Bid for More Documents in Feds’ Charity Fraud Suit

Teva Pharmaceuticals USA Inc. was properly denied additional documents to defend against the US government’s kickback suit alleging that the company paid more than $300 million to charitable foundations to generate prescriptions of the company’s multiple sclerosis drug Copaxone, a Massachusetts federal district court said.

The government contends that Teva violated the False Claims Act by submitting claims to Medicare that were tainted by kickbacks in the form of illegal Copaxone subsidies. A magistrate judge on June 7 denied Teva’s motion to compel certain Medicare claims data the company said could be used to rebut the government’s arguments.
