Teva Investors Can Resume Copaxone Kickback Scheme Class Action

Teva Pharmaceuticals Industries Ltd. shareholders can resume their class action alleging that the pharmaceutical company misled them about a kickback scheme involving multiple sclerosis drug Copaxone, a federal district court said.

The US District Court for the Eastern District of Pennsylvania stayed the suit in 2022 pending the resolution of a related False Claims Act suit against Teva. But the stay is now lifted because the plaintiffs will suffer prejudice from the risk of witnesses’ fading memories and lost evidence if it continues, Judge Karen Spencer Marston said in an Aug. 30 opinion.
