Tata Consultancy Services Ltd. defeated a whistleblower’s attempt to reinstate a False Claims Act suit that alleged the India-based IT services company fraudulently deprived the government of funds related to foreign worker visas, the Fifth Circuit said Wednesday.
A Texas federal district court correctly rejected Jack “Jay” Palmer’s counts alleging reverse false claims, which occur when a defendant conceals an obligation to pay the government, the US Court of Appeals for the Fifth Circuit affirmed.
