Tata America International Corp. failed to show that the National Institutes of Health’s IT procurement known as Chief Information Officer-Solutions and Partners (CIO-SP4) is unduly restrictive of competition because of corporate experience requirements, the GAO said in a decision released Monday.
Tata said the procurement improperly requires bidders to disclose confidential information about their customers and contracts to compete.
But the procurement reasonably seeks this information to ensure that a bidder’s claimed experience is legitimate, the Government Accountability Office said.
Relying solely on a bidder’s representations about experience poses a risk of fraudulent bid submissions, the GAO said.
