Supreme Court Won’t Review Whistleblowers’ Hospice Kickback Suit

The US Supreme Court announced Monday that it won’t review whistleblowers’ claims that Bethany Hospice and Palliative Care LLC violated the False Claims Act by paying doctors in exchange for patient referrals.

Whistleblowers Jolie Johnson and the estate of Debbie Helmly failed to adequately allege Bethany Hospice actually billed Medicare for services, according to tThe US Court of Appeals for the Eleventh Circuit.

Their petition for review, filed in September 2021, argued that the whistleblowers’ firsthand knowledge of billing practices should have been enough for the suit to continue.
