Siemens Defeats Bid to Reinstate Medical Device Fraud Lawsuit

Siemens Medical Solutions USA Inc. showed that a New York federal district court properly dismissed a False Claims Act suit alleging the company caused customers to bill federal health-care programs for flawed in vitro diagnostic devices, an appeals court said Tuesday.

The district court correctly found that whisleblower Mary Bixler Wood didn’t plead fraud with adequate particularity, the US Court of Appeals for the Second Circuit said in a nonprecedential summary order to affirm.

Wood didn’t identify the who, what, when, where, and how of the fraud Siemens allegedly perpetrated on the government, the opinion said.
