Ship Repair Firm Can’t Protest Navy Contract Performance Report

Colonna’s Shipyard Inc. can’t raise a protest claiming it lost a ship maintenance contract to a competitor because the Navy allegedly improperly relied on an unfavorable contract performance assessment report involving a separate contract, the U.S. Court of Federal Claims said.

The challenge to the report’s accuracy isn’t within the court’s bid protest jurisdiction, Judge Patrica E. Campbell Smith said in a opinion released Tuesday.

The Federal Circuit has strongly discouraged challenging performance assessments through bid protests, the court said.
