Sekri Inc. won its pre-award protest to stop the Defense Logistics Agency’s “unlawful” procurement for advanced tactical assault panels, which are components of protective ballistic vests.
Sekri—a qualified mandatory source under the AbilityOne program—sued in January 2021, asserting that DLA improperly decided to hold a competition to provide the panels instead of recognizing that Sekri was the only lawful option.
The Javits-Wagner-O’Day Act requires federal agencies to purchase suitable commodities from nonprofit agencies that employ a certain percentage of blind or severely disabled individuals, and is administered by the AbilityOne Commission.
