Safeguard Loses Appeal Challenging B&O’s $78 Million Dorm Award

Safeguard Base Operations LLC failed to show that the Department of Homeland Security improperly awarded B&O Joint Venture LLC a $78 million dormitory management services contract award, the Federal Circuit affirmed Thursday.

A split panel of the Federal Circuit, in a matter of first impression, said the U.S. Court of Federal Claims has jurisdiction over a claim that the government breached an implied-in-fact contract to fairly and honestly consider a bidder’s proposal in the procurement context.
