Therapy Resources Management LLC convinced the First Circuit to uphold a trial court rejection of its ex-employee’s whistleblower suit, which claimed the rehabilitation services firm fired her for calling attention to Medicare fraud.
The district court correctly found that TRM didn’t violate the False Claims Act’s anti-retaliation provision when it fired physical therapist Rosemary Morgan-Lee, the US Court of Appeals for the First Circuit said in a Monday opinion.
Morgan-Lee sued TRM and several other companies in 2013 at the US District Court for the District of Massachusetts, alleging improper Medicare billing.
