Radiology Firm Agrees to Settle False Claims Case for $5 Million

California-based Omega Imaging Inc. and a doctor agreed to settle a whistleblower’s False Claims Act lawsuit alleging improper billing for radiology services under federal health-care programs, according to a filing in federal court in California.

Omega and William M. Kelly M.D. Inc. will pay $5 million plus $50,000 in attorneys’ fees under the settlement, said Brian S. Harnick of Roemer and Harnik LLP, the attorney for whistleblower Syd Ackerman. The agreement must be approved by Judge Jesus G. Bernal of the U.S. District Court for the Central District of California.
