Procarent Shakes Ambulance Fraud Claims, Not Retaliation Claims

Ambulance services provider Procarent Inc. must face claims that it violated the False Claims Act by firing whistleblowers for calling attention to alleged improper Medicare billing, a Kentucky federal district court said.

Former Procarent employees Theresa Dunn, Aprill Kesterson, and Angela Foltz sufficiently argued that they were fired for complaining about Procarent’s alleged billing of services that weren’t medically necessary and lacked required documentation, Judge Claria Horn Boom of the US District Court for the Western District of Kentucky said in a Wednesday order.
