Philips Defeats Whistleblower’s CPAP Machine Kickback Lawsuit

Philips Respironics and related companies won the dismissal of a whistleblower’s suit alleging they violated the False Claims Act by engaging in kickback schemes to encourage purchases of respiratory and sleep therapy products, a federal district court said.

Whistleblower Chad Dietz failed to sufficiently allege that Philips knowingly and willfully engaged in illegal conduct, Judge Christy Criswell Wiegand of the US District Court for the Western District of Pennsylvania said in a Wednesday order granting the defendants’ motion to dismiss.
