Pharmerica Corp. and others won dismissal of a whistleblower’s False Claims Act suit alleging that they engaged in a scheme to improperly bill Medicare and Medicaid for prescription drugs, according to a decision by a New York federal district court.
Pharmacist Kaveh Askari failed to allege with particularity that the defendants submitted any false claims to the government, Judge George B. Daniels of the US District Court for the Southern District of New York said in a Thursday order.
The complaint didn’t allege which laws, regulations, or requirements defendants failed to satisfy, the court said.
