JP Pharma LLC, which owns several pharmacies, must face a False Claims Act suit alleging it defrauded federal health-care programs by improperly billing them for compound drugs, a federal district court said.
Virginia-based pharmacist and whistleblower Edward Breslow adequately alleged that prescriptions the company’s pharmacies filled were medically unnecessary, and that the defendants submitted kickback-tainted claims to the government for reimbursement, Judge Michael F. Urbanski of the US District Court for the Western District of Virginia said in a Tuesday opinion denying a motion to dismiss the case.
