Pacific Engineering’s Missile Contract Proposal Was ‘Too Risky’

Pacific Engineering Inc. failed to demonstrate that the US Navy unfairly assigned weaknesses to its contract proposal before awarding rival bidder BAE Systems Land & Sea Armaments LP a $317 million contract for MK 41 Vertical Launching System canister production.

The Navy reasonably concluded that Pacific Engineering’s inability to show it would timely produce canisters was “too risky” for national security, Judge Elaine D. Kaplan of the US Court of Federal Claims said in an opinion made public Thursday. The court announced its decision upholding BAE’s selection in a Oct. 8 judgment.
