OSC Solutions Inc. failed to demonstrate that the US Navy breached a parts and materials contract by not paying the contractor requested labor costs, the Federal Circuit ruled Wednesday.
The Armed Services Board of Contract Appeals properly found that the parties’ $70 million blanket purchase agreement didn’t give OSC the right to recover about $1 million in claimed costs, Judge Richard G. Taranto of the US Court of Appeals for the Federal Circuit said in a nonprecedential opinion to affirm.
