Olympus Defeats Retaliation Suit by VA Contracts Whistleblower

Medical technology company Olympus Corp. of the Americas no longer has to defend against a suit alleging it fired an executive in retaliation for calling attention to federal contracts mismanagement, a Pennsylvania federal court said.

Whistleblower Paul Lisenby’s National Defense Authorization Act claim failed because he didn’t allege an objectively reasonable belief Olympus engaged in gross mismanagement of US Department of Veterans Affairs contracts, Judge Jeffrey L. Schmehl said. Schmehl’s Tuesday opinion in the US District Court for the Eastern District of Pennsylvania dismissed the suit.
