New York Medicaid Fraud Appeal Judges Refuse Recusal Request

A False Claims Act whistleblower failed to show that two Second Circuit judges should be removed from the panel considering whether Catholic Health System of Long Island Inc. should face his Medicaid fraud claims, the appeals court ruled Tuesday in a one-page order.

Michael Quartararo argued that Judge Richard J. Sullivan should be disqualified because of his connections to the Roman Catholic Diocese of Rockville Centre on Long Island, which is directly affiliated with CHS.
