New York Health Management Company Hit With Retaliation Suit

New York-based Center Management Group LLC and Pennsylvania-based St. Francis Center for Rehabilitation & Healthcare are accused of violating the False Claims Act by firing an employee in retaliation for calling attention to Medicare fraud.

Speech language pathologist Alexa Kaner says she was fired because she complained that the defendants engaged in upcoding, which involves adding fraudulent billing codes for services not actually rendered or that aren’t medically necessary, according to a complaint filed Thursday in the US District Court for the Eastern District of Pennsylvania.
