New Orleans Flood Prevention Contractor Denied Costs Appeals

David Boland Inc. lost appeals seeking additional compensation under a US Army Corps of Engineers flood prevention project performed in New Orleans, the Armed Services Board of Contract Appeals said in a decision released Thursday.

Boland sought about $7.9 million in additional costs on behalf of its subcontractor Target Construction Inc., that it said were caused by delays from trains passing through the project area. The contract provided that 10 to 15 trains would cause work stoppages each day, but Boland said the subcontractor endured more train delays than it expected.
