A whistleblower suit alleging that Wolf Creek Federal Services violated the False Claims Act by overbilling NASA under a repair and maintenance contract has been dismissed.
Judge Dan Aaron Polster of the US District Court for the Northern District of Ohio granted the government’s motions to intervene and dismiss whistleblower USN4U LLC’s suit in a Thursday order.
A lack of evidence of fraud and unlikelihood of success on the merits, as well as the burden the case would put on the government, justifies dismissal, the court said.
