The operator of a long-term nursing care and rehabilitation center in Lake Katrine, N.Y., defeated a whistleblower’s False Claims Act suit alleging inadequate care for Medicaid and Medicare beneficiaries at the onset of the Covid-19 pandemic, a district court said.
Nicole Conte, former employee of Ten Broeck Center, which is operated by Kingston NH Operations LLC, failed to plausibly suggest false or fraudulent billing practices, Chief Judge Glenn T. Suddaby of the U.S. District Court for the Northern District of New York said in a Monday order.
