Mississippi nursing home GGNSC Southaven LLC is entitled to attorneys’ fees from a whistleblower who filed a “patently and demonstrably frivolous” False Claims Act lawsuit accusing it of improperly billing Medicaid and Medicare.
Whistleblower and attorney Cameron Jehl, who sought over $30 million in damages, alleged that GGNSC’s claims were fraudulent because it knowingly employed a nursing director who wasn’t licensed or lawfully authorized to practice in the state. A federal district court granted GGNSC summary judgment in March 2022. The US Court of Appeals for the Fifth Circuit affirmed that decision in December.
