Merck KGaA Gets Whistleblower’s Vaccine Fraud Suit Thrown Out

Merck KGaA and others won dismissal of a whistleblower suit alleging that the defendants defrauded the US government by supplying Covid-19 vaccines that had been stored in unsanitary conditions, in violation of the False Claims Act.

David Stonebrook’s complaint lacked sufficient particularity as to when or where the defendants would have submitted false claims to the government, Judge Denise J. Casper of the US District Court for the District of Massachusetts said in a March 15 order dismissing the suit.

The complaint lacked specifics as to how many false claims were submitted, the court said.
