McKesson Kickback Case’s State Law Claims Axed by Federal Court

A whistleblower’s state law claims alleging McKesson Corp. engaged in a cancer drug kickback scheme must be dismissed, a New York federal district court said.

Exercising supplemental jurisdiction over state False Claims Act claims would be “inappropriate” given how all federal FCA claims against McKesson have been dismissed, and the case is nowhere near trial, Judge Ronnie Abrams of the US District Court for the Southern District of New York said in a Thursday order to dismiss and close the case.

The state law claims are dismissed without prejudice to refiling in state court, Abrams said.
