Kropp Gets Court to Set Aside Defense Agency’s Fuel Card Award

Kropp Holdings Inc. showed the US Defense Logistics Agency erred in its selection of Associated Energy Group LLC to manage the AIR Card program, which allows for the procurement of aviation fuel at commercial airports.

The $24 million contract award was unreasonable because Associated Energy’s bid was untimely under the Federal Acquisition Regulation’s “late is late” rule, Judge Zachary N. Somers of the US Court of Federal Claims said in a Wednesday judgment permanently enjoining the contract. He also said the agency improperly attributed Associated Energy’s overall corporate experience and past performance to the company’s “walled-off subdivision,” among other reasons. ...
