Kindred Healthcare, Whistleblower End Nursing Home Fraud Suit

Kindred Healthcare Inc. and a whistleblower resolved a False Claims Act dispute in which the whistleblower alleged that the company engaged in a scheme to improperly bill Medicare and Medicaid for nursing home services.

Kindred and the whistleblower, Timothy Sirls, filed March 24 a joint notice of stipulation and consent to voluntary dismissal. Judge Karen S. Marston of the US District Court for the Eastern District of Pennsylvania dismissed all of of Sirls’ claims in a Monday order. Marston’s Dec. 9 order said the parties were finalizing a settlement.
