KBR Defeats Suit From Workers Injured in Iran Missile Attack

KBR Inc. will avoid a lawsuit alleging it failed to protect contractor employees from injuries they suffered during Iran’s missile attack on a US military base in Iraq in January 2020, the Fifth Circuit affirmed.

The suit is precluded by the Defense Base Act, a workplace compensation statute, which bars negligence suits filed by civilian contractors for injuries sustained on military bases in foreign countries while performing functions under government contracts, the US Court of Appeals for the Fifth Circuit said Thursday in a nonprecedential opinion.
