JAAAT Technical Services LLC may pursue a $2.5 million claim for costs under a U.S. Army Corps of Engineers contract to build a sensitive compartmented information facility at Ford Gordon, Ga., because the doctrine of judicial estoppel doesn’t apply, the Armed Services Board of Contract Appeals said in a decision released Tuesday.
Judicial estoppel doesn’t bar JAAAT’s claim that the agency interfered with its ability to obtain a pollutant discharge permit because a related state court contract dispute with subcontractor Tetra Tech ended in a settlement, Administrative Judge James R. Sweet said.
