J&J, DePuy Win Fees From Whistleblowers in Hip Implant Case

DePuy Orthopaedics Inc., DePuy Inc., and Johnson & Johnson Servs. Inc. are entitled to costs associated with litigating a now-dismissed False Claims Act suit alleging misrepresentations about a hip implant device, a Massachusetts district court said.

Fees are appropriate under a federal procedure rule that allows a prevailing party to recover reasonable costs, such as printing and docket fees, Chief Magistrate Judge Page Kelley of the U.S. District Court for the District of Massachusetts said in a Monday opinion.
